Booking Terms & Conditions

General T&Cs

 

1. Acceptance of terms and conditions

By booking or attending a session with us you accept these terms and conditions and they will form part of the contract between us.  You consent to your data being processed by our systems in relation to your booking.

2. Responsible Parties 

  • All bookings are made with Cambridge Sport Lakes Trust (CSLT), Milton Country Park, Cambridge Rd, Milton, Cambridge, CB24 6AZ. 

  • The terms and conditions of all agreements made with CSLT shall be subject to, and governed by, English law.  You agree that any disputes shall be resolved exclusively by English courts.

  • CSLT is licensed under the AALA regulations to provide water sports activities for U18s.

 

3. Session Content

  • Sessions are sold according to the description and content as described on the website. 

  • For courses and lessons, this does not guarantee a level ascertained on completion or certification if the required competency is not obtained.

 

4. Weather

  • We are not responsible for weather and have no control over it.

  • As an outdoor venue we expect to operate in all but the most extreme conditions.

  • Where sessions must be cancelled due to the weather we make every effort to provide alternative activities and dates, subject to availability. 

  • Refunds are not given due to weather conditions.

 

5. Arrival

  • It is your responsibility to arrive in good time for your session.

  • If you are late and a safety briefing has begun you may not be able to join the class as this causes disruption to the group and puts your safety at risk. In this circumstance you will not be refunded for your session.

 

6. Young People

  • Where U16s are participating in activities, they must be picked up and dropped off by a parent or guardian unless otherwise arranged in writing

  • We recommend an adult stay on site where possible in case of emergencies.

  • Under 8s must be accompanied by an adult at all times, unless otherwise arranged in writing.

  • Minimum ages are defined in session descriptions and must be adhered to unless agreed in advance in writing with CSLT.

 

7. Acceptance of Risk

  • All activities provided by CSLT involve an element of risk, whether this on land or on water. Participants agree to undertake activities at their own risk.

  • You accept that you are acting at your own risk and that we shall not be liable for any injury or any other matter suffered by you in the session or as a result of the session including without limitation for any water or soil borne diseases and/or any injuries caused by wildlife, other users and equipment.

  • You consent to basic first aid to be administered if necessary, by a qualified first aider, while on site.

  • It is the responsibility of the participant to ensure they are sufficiently fit and well to attend a session

 

8. Conduct

  • Any person found to be under the influence of alcohol or drugs during a session will be deemed unfit and refused participation with no right to a refund

  • Abuse of our staff in any way, shape or form is not tolerated and will result in termination of the session with no refund.

  • All information provided regarding medical conditions is accurate with no omissions, to the best of your knowledge

 

9. Cancellation

  • Cancellations more than 14 days in advance of a course commencing will be subject to a full refund. After this time, no refunds are available. 

  • You may transfer a booking to another person by contacting the office (mcp@cambridgesportlakes.org.uk) in advance of your session. The new participant will be required to complete a short form beforehand.

  • CSLT reserves the right to cancel any course or lesson for any reason at any time before the start of the course.  In this situation participants will be offered alternative dates or a full refund. All re-bookings will be handled directly with participants in the event of adverse conditions.

  • Cancellation due to situations out of the control of Cambridge Sport Lakes Trust's control may be subject to the loss of money paid where a refund is not possible.

  • A failure to attend a booked course will be considered a cancellation.

 

10. Limitations of Liability

Whilst every reasonable precaution is taken by us to ensure security and safety at our sessions, we shall not in any way be liable for any loss or damage arising in any way from our sessions or venue we use. However, nothing in these terms and conditions shall limit the liability of any person for death or personal injury caused by negligence.

In any event, we shall not be liable to you:

  • For any purely economic loss, for consequential or indirect losses or for any loss of profit or opportunity;

  • (Where the claim is insured) for any loss which we are unable to recover from any insurer:

  • (Where the claim arises as a result of something which was done or not done by a third party) for any loss which we are unable to recover from that third party; and

  • For any loss which is greater than the fee paid by you for the relevant session.

In the event that you cause harm, damage, loss or injury to any other person or property during the session, you agree to indemnify us and reimburse us for all claims, losses, damages, expenses (including reasonable legal fees) and any other liability suffered by us as a result of such harm, damage, loss or injury caused by you.

We shall not be liable for any loss or theft of your personal possessions and all property left by you, anywhere on site, is done so at your own risk.

Water T&Cs (In addition to general T&Cs)

 

1. Acceptance of terms and conditions

By booking or attending a watersports session with us you accept these terms and conditions as well as our standard T&Cs and they will form part of the contract between us. 

 

2. Minimum Ability

In order to attend watersports sessions you must be confident to swim 100m in a buoyancy aid and be confident in and around the water. You must be fit and well on the day of the course.

If in our opinion you are unable to comply with these minimum requirements then we may cancel your place in the session. If you have already paid, we will offer you credit.

 

3. Clothing

All participants are required to wear suitable clothing for watersports. This includes clothing that can get wet and appropriate footwear that can be worn on and in the water.

Wetsuits are compulsory on paddleboards below 16 degrees Centigrade. If you choose not to wear a wetsuit then you enter the water entirely at your own risk and we shall not be liable for any accidents or injuries you sustain.

Participants must bring a towel and change of clothes (including shoes) to all sessions as there is no guarantee they will stay dry in any session involving the water.

Swim T&Cs (in addition to general T&Cs)

 

1. Acceptance of terms and conditions

By booking or attending a swim session with us you accept these terms and conditions as well as our standard T&Cs and they will form part of the contract between us. 

 

2. Minimum Ability

In order to attend this session you must be able to swim a minimum of 400m continuously and without rest. You must also be able to tread water easily. 

If in our opinion you are unable to comply with these minimum requirements then we may cancel your place in the session. If you have already paid, we will offer you credit.

 

3. Illness, medical conditions and acceptance of risk.

It is your responsibility to ensure that you are medically fit to swim and that at the start of a session you will notify us of any relevant medical conditions. By booking or attending a session with us you confirm to us that:

  • You are fit to swim in open water

  • You meet the minimum requirements for swimming ability set out in section 2 of these terms and conditions.

  • All personal information you have provided to us is correct and not misleading; and

  • You understand the dangers of swimming in open water and you agree to swim at your own risk

 

We will not be liable for any accidents or injuries arising from swimming with us, save that nothing in these terms and conditions will limit the liability of any person for death or personal injury caused by negligence.

 

4. Safety and general rules

  • Swimmers are responsible for their safety, actions and behaviour on any part of the site property.

  • Safety for all is our paramount concern and we have the right to remove anyone on, in or around the site who gives us any concern whatsoever with regard to safety.

  • If you choose not to wear a wetsuit then you enter the water entirely at your own risk and we shall not be liable for any accidents or injuries you sustain.

  • Open water swimming by its nature presents risks to the swimmer over and above those found in a swimming pool and by booking an open water session you accept that you are acting at your own risk and that we shall not be liable for any injury or any other matter suffered by you in the session or as a result of the session (including without limitation for any water borne diseases and/or any injuries caused by wildlife in/on the water.

 

5. Young People

We encourage young people to take part in specifically organised sessions such as Junior Tri, however they may swim at general sessions in line with the following rules:

  • Wetsuits must be worn in water temperatures under 23oC

  • An U18s parent or guardian must give permission and have assumed responsibility to ensure they meet the ability as outlined in section 2

  • Under 12s must be accompanied on the water at all times, Under 16s must be supervised by a responsible adult from the bank.

Wild Place, Orchard, Dell, Copse & Sundial Self-Led Booking T&Cs

 

1. Acceptance of terms and conditions

By booking one of our Venues (Wild Place, Orchard, Dell or Copse) for self-led hire you accept these terms and conditions as well as our standard T&Cs and they will form part of the contract between us. 

 

2. Set-up and Take Down

You may only access the venue during the times indicated on your booking. Please ensure you book sufficient time for set-up and takedown.

Venues must be left in the same condition you found them. This includes taking down any dens, washing any dishes and removing rubbish to the bins provided.

 

3. Duty of Care

  • You take responsibility for the actions of your group and for any incidents or accidents that may occur during your hire. 

  • The Duty Manager may facilitate first aid or access of emergency vehicles, however if they are not available the responsibility falls to you to ensure appropriate help is provided. This is particularly important if your session extends out of hours.

  • CSLT (Cambridge Sport Lakes Trust) takes no responsibility for any accident, injury or damage to property that may occur. CSLT cannot accept responsibility for any of your, your guest’s or supplier’s property and shall not be liable for any loss or damage to property brought to the Venue or left behind. 

  • Children must be supervised at all times.

  • CSLT staff and any person authorised by them shall have the right of free and unimpeded entry at all times and for all purposes to and from the Venue.

  • You must leave the Venue and the Milton Country Park in the state that you found them, any damages must be reported to the Duty Manager before leaving and you may be liable for any expense incurred in fixing them.

  • All equipment, fittings, etc, erected or brought into the Venue by you or third parties shall be removed immediately upon completion of the hiring unless prior agreement is made with CSLT. In the event of you failing to clear the venue to the satisfaction of CSLT this shall be done by CSLT at your sole expense.

  • You must provide proof, in advance, that you, or those contracted by you have adequate Public Liability Insurance, risk assessments and qualifications (if relevant) to provide a safe session and cover any claims arising directly from the activities or the use of any equipment brought into the Venue by you.

  • Any subcontractors must be declared in advance and cleared by CSLT as suitable to provide services on our site. We can provide a list of approved contractors if requested.

 

4. Fire Safety

  • Fires must only be lit in designated areas (fire pits).

  • You are responsible for ensuring that your group is safe around any fire you have. This includes providing sufficient water to extinguish the fire immediately and to cool any burns that occur. 

  • Group members should be briefed on fire safety before any fire is lit.  Children must be closely supervised at all times when near the fire.

  • Do not burn any wood other than that you bring yourself or is specifically provided for your group. Our wood piles are a valuable habitat for wildlife.  

  • Keep the fire under control. Large bonfires damage our firepit and the surrounding trees. Flames should reach no higher than an adult’s knee and the fire should remain within the firepit, without damaging the surrounding logs or overhead canopies. 

  • You must ensure your fire is safely extinguished before you leave unless requested otherwise by a member of staff.

 

5. Other park users

  • You must be considerate of other park users at all times. Your attendees and any subcontractors must not harass, impede or otherwise negatively impact other users of the park. Noise levels, including music must not impact on others enjoyment of the park. 

  • If any members of your party are disruptive, aggressive or harass CSLT staff or members of the public, you will be asked to leave immediately with no refund provided.

  • Council noise regulations require quiet after 11pm. This includes music, both live and recorded as well as general noise levels.

 

6. Payment of hire fees

  • CSLT requires full  payment in advance of the booking.

  • CSLT takes no responsibility for payment of subcontractors
